I said the criminal justice system isn’t the answer for all bad behavior. This statement implies that the criminal justice system is the answer to some bad behavior. It also leaves open the possibility that there could be laws for all bad behavior just that some have civil but not criminal remedies. It would be illogical to conclude that I don’t think there should be laws for bad behavior based on that statement. The entire thread is a straw man. The IL law as written in 1989 made it a felony for an HIV positive person to have unprotected sex with a person without disclosing their HIV diagnosis with that person. Transmission was never required. A lot has changed since 1989. Today with modern treatment HIV is not the death sentence it was back then and unprotected sex carries an effective 0% chance of transmission. An HIV positive individual taking antiretrovirals today would have a lower chance of passing the disease to their partner than an infected person in 1989 using a condom, yet could have been charged with a felony as recently as when this law was repealed (2021 - 5 years ago). It might be poor form/bad behavior to not share an HIV diagnosis with a sexual partner, but if the act has an effective 0% chance of passing the disease I don’t see the state’s interest in regulating it. It shouldn’t be a crime. If you want to make some other kind of law against it like a religious law have at it.

Another UNI coach David McCuskey. UNI had 7 top 4 finishes under McCuskey from 1937-1952. McCuskey then went to coach at the University of Iowa where the Hawkeyes had 5 top 4 finishes under him.

1971 PSU Tied for 4th place with Koll as the coach and in 1953 UNI was 4th with Koll as coach. The 3rd place finish I mentioned earlier came in 1963 when UNI had moved down to D2. That was at the D2 tournament.

The criminal justice system is not the answer for all bad behavior. I couldn’t find a state wide numbers for number of people charged and convicted under this, but I found some for Cook county. This is the county that contains nearly all of Chicago and roughly 40% of the population of the state. During the time the law was in force (1990-2021) ~80 people were charged under this law in Cook County with 20-30 convictions. About 15-20 of those charged were charged solely with this crime. That is to say they were charged with sexual assault, attempted murder, resisting arrest, etc. in addition to criminal transmission of HIV. That last one may seem unrelated but a handful or so of people were charged under this law for spitting at police officers and/or biting them whilst being arrested/detained for unrelated things. Some issues with the law are that actual transmission is not required. This leads to people with a very low chance of passing the virus, because they are taking modern antiretroviral drugs, being charged despite not actually infecting anyone and standing very little chance of doing so. Also it requires proving who knew/said what when and access to medical records. This can be difficult to ascertain as medical records are protected. Transmitting HIV to another person is not itself a crime. It’s not like if someone complains to the police that they were infected with HIV the state can go get the medical records of all the person’s past sexual partners to potentially substantiate a charge. The law requires the prosecutor to prove the individual has the specific intent to commit the offense. An offense would be knowing you had HIV and having sex without a condom without informing your partner of your HIV status. With modern antiretroviral drugs that make the probability of transmission near zero even when not using a condom it is unclear a case could be successfully prosecuted against someone using effective antiretrovirals and if it could would it be in the interest of justice to do so? The same number of individuals were prosecuted under the law in Cook County in the five years since it was repealed as the last five years it was in effect. The law was repealed in 2021 and Cook County had not attempted to prosecute anyone under it since 2016. In the 26 years they attempted to prosecute only 15-20 people with this as the sole charge. The other 60-65 cases included stacked charges implying that even after the law was repealed most of the conduct that was prosecuted under it remains illegal through other laws. The tweet Caviera posted was misleading and false. It made it sound like this was a recent thing - it happened 5 years ago. It implied the governor did it to shield illegal immigrants from prosecution under the law after a surge in HIV cases in the Latino community. It gave no evidence of this increase just mentions a “ recent spike” in city data. If it was recent then how did the governor see this coming 5 years ago? And even if he was prescient, why would he feel the need to protect illegal immigrants from a law that had not been enforced in 5 years?

Certainly murder rates go up and down. Take a down year. Take the most down year over the past 40 years. How many murders were there in Chicago in this extreme down year? ~400? Now compare that with the total number of people successfully prosecuted under this repealed HIV law in the entire state of Illinois over its entire history. Which number is larger? This is a pretty rare crime and/or it’s extremely difficult to prove/prosecute.

Now you are using the same as justification that the video is real, well that and the “fact” that the average IQ is 68. The reality is that you would accept any low number for average IQ as true and any cartoonishly entitled rant video as legit because that fits how you view Somalis. You’ve set yourself up to be duped in this manner. This is like when Joe Rogan got duped by that fake video of Tim Walz dancing. The video is so absurd most people would immediately question its authenticity, but Rogan’s low opinion of Walz resulted in him accepting it without asking questions. It made him look very foolish. The same is happening here except with the ironic twist that you are being duped whilst calling Somalis low IQ. It is very funny.

You might have a point Texas decriminalized this in the 1990s when democrats controlled the house with a republican governor. Looking at the map Danny Deck posted lots of "red" states don't criminalize this.

That whole tweet is bizarre. This isn’t news. Illinois decriminalized this five years ago. Why comment on it now as if it’s news and note the interesting timing? When you choose to bring something up 5 years later and note the timing that isn’t a coincidence. Then it ends with “This is the Democrat Party” seemingly blaming Democrats for getting this wrong. Illinois was not the first state to repeal a law making HIV a crime. That was Texas which is not controlled by the Democrat party. If both democrats and republicans are doing this then maybe it’s just a law and wasn't working. You spend a large amount of time in an exceptionally weird corner of twitter. That page lists the Somali IQ as 83, but that is based on test takers at the international IQ test website over the past year and there were only 141 test takers from Somalia a nation of 19M. If you’re talking about the Lynn-Becker estimate they measured the IQ of a few thousand refugee children. You are way too confident in the number you like which for some reason is the lower one. The two numbers for Somalia on that page are different by 15 points which should be the standard deviation in test scores. The US is different by a few points. Clearly there are issues with the measurement and/or sampling for the Somali data.

The point is you claim it’s real, but cannot identify the person in the video. Neither can any news outlet. What account first posted it? You likely got duped. Why are they here? They came here as refugees for the same reason all refugees come here.

That's possible, but doesn't change the analysis much. With it going viral he would have been identified and shamed. That hasn't happened, so either he either is a proud freeloader that keeps a very low profile apart from posting videos shit talking the US taxpayer on TikTok or maybe the videos doesn't show an actual Somali-American and proud SNAP benefit recipient.
