Wow...#1 126lber in USA gets disqualified after District Tournament

The lawyer has a good point about there being no bench.  If that’s what NJSIAA is saying was the violation I’m thinking he’s going to get it overturned

The judge seemed a little skeptical of the plaintiff's filing.

Either way he said he would have a decision by late morning tomorrow, but was hoping for end of day today.

This is a great point, as much as its important to respect and protect the decorum of athletic events, you can't just arbitrary deem the entire gymnasium "the bench", and you can't put athletes in a position to not protect or defend themselves if sleeveless TRT comes rumbling at you.  

I am not taking a position on what knox did, but deeming the bleachers the "bench" would put athletes in a position to have to just eat whatever heat was thrown their way by a random aggro passerby in the gym who just blows their top.

This would in fact be a tremendous story, and if it gets overturned and knox performs, would bode real well for his college career.

The gameness it takes to go from high school career ended (and college in jeopardy) to getting reinstated, making weight, and wrestling are tremendous.  Tonight is definitely one of the wildest weight cut of this kid's life.

Were these random aggros or Jersey Mike not being able to keep his cool when a bunch of a**holes said bad stuff to him?

Well if they determined that Knox threw a punch then they should be able to use that as the reason for DQ’ing him.  But if they’re going with “leaving the bench during an altercation” or whatever, that seems shaky.

The NJSI lawyer said they had a statement from a witness who said Knox Jr. punched him and that Knox Jr. has not denied that claim.

This was actually my first thought on the whole thing, but I was too lazy to look into NJSIAA regulations had definitions for terms in their rules.  At these types of tournaments, there aren't "benches" people are all over the gym, though usually teams sit together.

I'm skeptical of the Knox's attorney's Constitutional argument, since this is an administrative body, not a criminal proceeding.  So this would then, in my mind, fall to the sportsmanship aspect of the disqualification, and I think Knox loses there, since that's a pretty amorphous thing.

The lawyer referred to "the official video" and said others do not meet the definition of evidence. Not sure what that video shows or if the lawyer is right.

Not sure I can trust legal advice from someone who can't even begin an internet discussion with "IANAL but". This is the internet and how else can I do my own research to not be a sheeple in the lamestream media.

I listened a little and thought the following were interesting statements

Plaintiff's Attorney:

  • There is no defined bench
  • There was no ongoing contest
  • Not sure what video the NJSIAA is relying on
  • Discovery was not timely. Only received this morning.
  • Due process requires a meeting with legal representation, which implies the right to cross examine.
  • Even if it is determined the plaintiff did what is alleged, there are other penalties available.

Defendant's Attorney:

  • Plaintiff does not deny leaving the bench and joining melee or assaulting a member of the crowd
  • There is no dispute of the facts or the conduct of the plaintiff (the Plaintiff's Attorney disagreed with this statement)
  • Immediate relief is not required
  • This opens the court to more broadly spend time determining student/athlete eligibility. Do they want to do that?
  • Plaintiff was invited to submit evidence without limitation.
  • A victim identified the plaintiff as the person who punched him.
  • Motivation for attacking is not the issue as these are strict liability regulations, and the plaintiff cannot be allowed to decide what is reserved for the police.

The judge asked few questions. The only one I remember was whether anyone was arrested. The defendant's attorney said Knox Jr. and Knox Sr. were the only ones detained and that the police were investigating to determine if charges are warranted.

The judge pointed out that the plaintiff's statement of events seemed to leave out any mention of what happened between the conclusion of the bout and the defendant appearing in the stands during the melee.

Not sure what any of that means for the requested injunction, but found it interesting.

@VakAttack break this down for us. Would the "official video" be defined as the one that is ran by the tournament?  I can't imagine other videos not being admissible.
