CNN says Luigi's been charged with second-degree murder, which could mean 15 years to life if he's found guilty.

New York has been wrong since 2004.   The final, fitting punishment for murder is swift capital punishment.

If he stalked the guy all night.  Prepared.  Brought gun ammo etc.  labeled it with whatever political words he used (I forgot)… how is that not pre meditated first degree murder?

First-degree murder in NY is the intentional killing with specific aggravating factors:

  • Killing police, peace officers, firefighters on duty.
  • For hire, witness intimidation, terrorism.
  • During specific felonies like robbery, kidnapping.
  • Multiple murders, torture, or killing a judge.
  • Defendant over 18 at time of crime.

First degree conviction is sentencing to life without parole.  That is unless it is later changed to life with parole for good behavior, which has and does (rarely) occur.

Second degree is minimum of 15 years with parole possibility.

Do they legally define terrorism in NY? I ask, because this killing pretty much meets the definition I used for terrorism in my grad class: Murder against a civilian to create terror in order to achieve a political or social goal.

But as Pocahontas said, murder is wrong BUT you can only push people so far.   She's had to backtrack on that line.  Waiting for AOC to do the same.   Won't hold my breath or anything.

Yes.  Is there enough evidence to determine Luigi meant to intimidate or coerce a civilian population?  That depends on what his manifesto says, and what he says, and such.  There is evidence that he found violence committed by others coerce the civilian population as "interesting."

  Quote

A person is guilty of a crime of terrorism when, with intent to intimidate or coerce a civilian population, influence the policy of a unit of government by intimidation or coercion, or affect the conduct of a unit of government by murder, assassination or kidnapping, he or she commits a specified offense.

Doesn't sound like it meets the NY definition.

He should be eligible for the death penalty.    I know in ny that’s not possible …. But he should be eligible for it.

Should be automatic if no doubt in the conviction.

Apparently there's a bunch of movements online to give him money on his books, or to help him pay for an attorney. I guess he's gone viral, by being infamous. I think if he goes to trial his best bet is jury nullification. If he has a competent attorney, all they need is one juror who got screwed over by health insurance somehow.

Clarify. What, exactly is your specific problem here?

  • Murder is wrong, do you disagree?
  • You can only push people so far, do you disagree?

What part of what was said made you think that you should belittle her?

I'll start:

I disagree with you using 'Pocahontas' to attempt to belittle someone you've never even met.

Keep in mind that she doesn't know you, has never met you personally, and knows nothing about you at all.

I do know you, at least from internet forum interactions, and I'd trust her 100% more than you.

You suck at this.

While I tend to agree with the intent of what you are saying, but turn that around on yourself...have you met Trump in person?

Have you?

The reason I ask is that there is a significant financial barrier that wasn't erected by accident. If you'd like to meet Trump it will cost you quite a lot of money. It's by design for Trump's financial gain. Consider it a filter.

What's interesting here is that if you follow Trump, he only references the billionaires he's known and has met. No matter how bright and shiny you are, you won't make a dent in his circle of billionaires and multi-billionaires. He's always and only about piles of money.

99% of us don't have that kind of money. Which is unfortunate. He's only about the 1%.

I don't need to attempt to belittle him with name calling. The facts speak for themselves.

To be fair, he doesn't really either. He just acts like it and lives on credit. Real billionaires despise him, the only reason they're crowded around now is because he has power.

I disagree with your disagreement.   Her intent was to support the shooter.   Murder is wrong BUT......

But nothing.   Murder is wrong.   When people  get pushed too far, they go to court, they settle their differences within the law.   Plus, she assumed he did this because he was wronged somehow.   And came to this conclusion before any real facts came out.   Yes, he has back problems and had surgery because of it.   He did no business with United Healthcare and was never a client of theirs.   So he was pushed so far that he chose a random CEO to kill?   I made fun of her because her position is clearly ignorant and she proved that by clarifying saying murder is wrong period.   So now that she has made her clarification, your questions are moot.   As they should be.   Keep up with the times my friendly little crustacean.

Not that murder is ever justified except in extreme cases....

I don't think anyone is justifying it. But there are enough people who maybe are affected by things this guy did, and have nothing to lose by killing him. It's not right but it's not exactly shocking to hear. I wouldn't say it should be a warning but if you dictate corporate policies like this, some people aren't going to exactly become your biggest fans.

I’ll just leave this rigit here @Tripnsweep
