There's your crime, intent and thus felony. I don't know why they bothered with the 34 checks & invoices case. The J walking case was a slam dunk. .

Was in favor of trying to lockdown the country "forever." That would obviously be unsustainable and bad for everyone regardless of political stance. If that's a bad thing - I'm not sure what the heck you are advocating for.
