If you inadvertently obtain DOD Classified material, as a private citizen what is the proper protocol going forward??

So, there was uproar that Walz/Hegseth shared classified information with A journalist...then it was determined that the information wasn't classified so there is uproar that they shouldn't be using an app that could be hacked, but wasn't, and then it's uproar over the sharing of the information being because of human error??  🙄

This was an unforced error by Walz/Hegseth, and they should be held accountable as appropriate; however, the partisan outrage is laughable...just admit your true outrage is that no matter what any of the R's do you are going to complain and find fault in it.

I will say again, I find it really weird and sad how a lot of you on here are cheering and hoping Trump and his administration fail...you do realize if that happens it is bad for not only the R supporters but for everyone...right?!?!?

Don't know how else to tell you this, but literally every portion of the message from Hegseth to the group about aircraft takeoff times, airframes, ToTs, was SECRET at a minimum. Anything that describes the movements of men, weapons and equipment is SECRET. Then, compilation raises that to TS.

Every single member of the DOD who has access to S// or TS// systems takes a Cyber Awareness and Derivative Classification course every year. It's pretty basic stuff.

Well, there you have it folks...Le duke has spoken...the USA will refer all national security, secret, top secret and classified material labeling to him.  🙄

I'll ask again, as others have too, who determines if messages are secret, top secret and classified if not Trump and his administration??

I googled it. The OCA. The Original Classification Authority. It is made up experts in different areas of our government. So, a high-ranking military official may be designated for classifying sensitive military intelligence.

Where does it say anything about the FBI in either section?

The law does not list who the civilian should report it to.  §793 is handled by the Department of Justice and the FBI is its investigative branch.  A civilian could report it to their local police, who will report it to the FBI or he could phone 1-800-CALL-FBI.

Had the information been classified, Goldberg could be reviewed for unauthorized possession and willful retention. He didn't share anything risky, just retained it for 10+ days.  After the information was claimed as "not classified", he was good (a little grey area) to retain and share.

So far as I can tell, Goldberg did not contact FBI, etc. agencies between receiving the information and publishing it.  He did notify the White House on March 25th around noon as a journalistic heads-up.

Had it been classified, Hegseth and Waltz would be in review for willfully communicating classified info to someone without clearance. Hegseth’s communication was unintentional to an outsider but reckless and punishable. Waltz’s intent depends on whether he meant to add the reporter; then he left him in when sensitive info was shared.  His own info sharing on positive ID has some risk.  He’s probably in trouble.

Ratcliffe is likely fine...  Vance and the others would not have legal risk either way.

Certainly Goldberg could have contacted the FBI to report Waltz/Hegseth/ect illegally sharing classified information with him.

Yes he had unauthorized possession, but he was sent it.  Unless he hacked into Waltz's phone to get into the chat he is in the clear on unauthorized possession.  The only thing criminal in Goldberg receiving the information was done by Waltz and the government officials in the chat.

793 does not make it illegal to retain the information.  It is illegal if the person with unauthorized possession "willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it."  Willfully retaining it is not illegal only willfully retaining and failing to deliver.  Goldberg did not do that.
