He said last week he would love to send US citizen criminals to El Salvador prison. He also reiterated those sentiments today in his meeting with the El Salvadorian President, siding on if he is administration deems it legal, when no legal scholar (outside of the administration at least) is seeing it as legal. The administration has already defied the federal court’s rulings on this matter.  This could be just the beginning of defying the court,  claiming it is interference by the court, as if checks and balances aren’t a central foundation to our government.

If this doesn’t sound alarm bells for you, you are much more in favor of licking his nuts than you are in favor of the United States Constitution, no matter what kind of weasel talk you use to try to squirm out of it so you can stand by your man.

Except that is not what he said. In the press availabilty he said he doesn't know what the law is but he wants to send our homegrown criminals. He is talking about US citizens.

And if you think you are safe because you haven't broken the law, what difference does that make? If someone is willing to send US citizens to Salvadorian prisons, what difference would guilt or innocence make to that kind of person? If Trump decides you are guilty, or inconvenient, you will be sent. Then he will tell Bukele to say it is impossible to get you back.

President of El Salvador, while sitting next to Trump, says he will not return the citizen who was wrongly deported without a hearing. The Supreme Court ruled 9-0 that this action was illegal and Trump must facilitate the man's return.

This "prison" is in fact a concentration camp, by every definition of the word. Inmates are often not formally charged with crimes, nor are they given a release date. Human Rights Watch is not aware of anybody being released from the prison. The population is now at 40,000. Prisoners' heads are shaved and they are packed into rooms like cattle with up to a 100 other prisoners.

Meanwhile, the American gestapo are ambushing legal residents and deporting them for their views on a foreign country.

How can any of you keep defending this? What will it take for you to wake up?

Sometimes I think Americans shouldn't be allowed to discuss the issues of other countries because we tend to have an inadequate understanding of their issues.

He was ordered deported in 2019.   For gang ties.    Totally illegal alien.

He appealed and was granted a stay, and put on “withholding of removal” status. No one ever proved he had gang ties.

He was also granted a work permit under the Trump administration. He had zero run-ins with the law.

Is that a thing?

-He was accused of gang ties via hearsay.  The man who accused him provided no proof.

-Another informant claimed he belonged to a MS-13 gang in somewhere NY.  There is no proof he ever traveled to NY.

-The government claimed he was MS-13 because of Chicago Bulls gear.  That's it.

-To this day no one has provided any concrete evidence he was involved in any gang activity.

I thought El Salvador also said he was  MS-13.  But my point/question: is there a known way of proving that someone belongs to some group.  For example how do you prove that I am a member of the PortaJohn fan club?

So one can go to trial to prove or disprove they are in a group?

Where are we going with this convo?  What are we trying to resolve?

I'm just trying to understand how you prove or disprove this.  Or if he is in El Salvador does it matter?

From what I've read there is no evidence he was a MS-13 member.  Maybe I'm wrong and he was but we might never know.   Garcia had a withholding order.  He wasn't supposed to be deported.

It shouldn't be hard to acknowledge that the DOJ messed up.

So why does El Salvador want to keep him locked up?

Because they as well as the Trump administration believe he is a member of MS-13.

From Noem vs Garcia page 33:

"Respondent stated that he intends to apply for relief in the form of asylum and adjustment of status based on his relationship to his fiance, whom he intends to marry. The Respondent also argued that he is not a danger to the community. He has no criminal convictions. He denied being a gang member and objected to the admissibility of the Form 1-213 and the Prince George's County Police Department Gang Field Interview Sheet because he lacked the opportunity to cross-examine the detective who determined that he is a gang member. The OHS opposed the Respondent's request for bond. The OHS asserted that the Respondent is a verified gang member. The Respondent was arrested in the company of other ranking gang members and was confirmed to be a ranking member of the MS-13 gang by a proven and reliable source. The OHS argued that the Form 1-213 is admissible as a legally reliable document in immigration court. "
