The more interesting element of this story is the whistleblower angle.

The story describes employees "whistleblowing" to the Board, and the Board retaliating against them. If that is the case, the employees really blew it (pun intended).

If, instead of complaing to the Board, they had done their whistleblowing to the DOL they would have been protected against retaliation. But by allegedly doing this with the Board, they were not. Doesn't mean no one will sue, just means, if they do, they will do it alone. Big mistake.

Whistle blowing to the board with the CEO retaliating against them and then buying them off as they went out the door.
